Japan stocks rally, as Nikkei Average tops 10,000

Craig Agranoff: Domain Names, Trademarks and Infringements

Most of us have probably run into this: you are starting a new website or expanding your business' current sites to include a new domain, but the domain that matches your trademarked name is owned by someone else. Worse? They're just squatting on it, waiting to sell it someone rather than using it for a website. Often, these sellers will be asking thousands of dollars for the domain name.

Do you pay that money to purchase it? Or should you enforce your trademark (TM) and try to take the domain on infringement grounds?

The legalities of domains and trademarks are not very cut-and-dry. In fact, they're extremely convoluted and even experts in the field can run into questions that they can't answer. There are two basic criteria that most trademark infringements, in regards to domain name registrations, must meet before they can be enforced. These define what's called "bad faith registration."

Dates of registration -- the trademark should usually have been registered (meaning the filing date, not the award date) before the domain name, otherwise the domain is probably not infringing on the TM. The exceptions are when domains are sold or transferred after TM registration, especially if those sales are to competitors to the TM owner.

Foreknowledge of the TM -- the person who owns the domain can sell or transfer the domain, or even legally purchase the domain after TM registration if he or she was not aware of the trademark. In other words, in order for infringement to be shown, the TM owner must have informed the domain owner that he or she owns a trademarked domain.

As an example to illustrate these two points, let us assume that a person has purchased "ABC123.com" and is planning to try to resell the domain because of its search engine optimization possibilities and perceived value due to its top level (dot com) low character count (only six). In the business of domaining, this is a common practice since domains are usually valued by keyword, length, and what kind of dot they carry. Dot com carries more value than dot tv or dot co, for example.

Now the ABC-123 Toy Company owns the trademark for "ABC 123" and has decided to begin a new toy line under the name. They registered the TM a couple of years before, but have not been using it up to this point. When they go to register the domain, they see that the domain owner who recently purchased the domain is asking $10,000 for it.

They have three options: offer to buy it, sue to take it, or inform the owner of the infringement and see if he or she will hand it over. In the first case, a lot of trouble and attorney fees can be saved, but a lot of money is spent regardlessly. In the second case, the fight could drag out and end up costing more than the purchase price. In the third case, the seller may not have any plans to hand it over and might jack up the price now that he knows someone really wants it.

Except that in the third case, the seller has now been informed that someone owns the TM for the domain they have and so the only legal buyer is now the ABC-123 Toy Company. If the seller attempts to sell to another party, or does sell to another party, then the seller or the new owner can be taken to arbitration and will almost certainly lose the domain (with no recompense from ABC-123) because the seller had previously been informed that the domain name infringed on a trademark.

That opens a new can of worms for the seller, who is now likely liable under the law for fraud.

The domain name buying and selling business is not as simple as it used to be, but domainers are usually aware that some of their domains are, eventually, going to infringe on someone's trademark registration. Talking with domainers that I know, I've found that most of them take this as a part of their business and when someone demands a domain based on TM infringements, they will check the trademark and if it's valid, they just hand over the domain. Otherwise, it becomes useless to them as they can no longer (easily) sell it without a lot of headaches appearing post-sale.

There are, of course, exceptions to these rules -- nothing is hard and fast. Neither am I an attorney, so what I tell you here is not legal advice and should not be taken as such. Still, the world of trademarks and domain names is convoluted and the two often bump heads.

Real Madrid stumbles again, in 2-2 tie vs Espanol

BARCELONA, Spain (AP) - Defending champion Real Madrid stumbled again in the Spanish league, allowing substitute Juan Albin to score off of a poorly defended corner kick in the 88th minute, giving relegation-threatened threatened Espanyol a 2-2 tie Sunday.

Sergio Garcia put the visitors ahead in the 31st minute, but Cristiano Ronaldo tied the score in first-half injury time with his 14th league goal of the season and 23rd overall.

Ronaldo set up Fabio Coentrao's goal that gave Madrid a 2-1 lead three minutes into the second half.

League-leading Barcelona (14-0-1) hosted second-place Atletico Madrid (12-2-1) in the late game. Real Madrid (10-3-3), which lost 2-1 at Celta Vigo on Tuesday in the first leg of their Spanish Cup fifth-round matchup, is 10 points out of first.

Elsewhere, U.S. captain Carlos Bocanegra returned from a torn muscle in his left leg, playing the entire match in Racing Santander's 1-0 home loss to Sabadell in Spain's second division.

The defender was injured in the Americans' 2-2 exhibition draw at Russia on Nov. 14, and Santander said a week later that it expected him to miss another six weeks.

MILAN (AP) - AC Milan midfielder Antonio Nocerino dedicated his goal in Sunday's 4-1 Italian league win over Pescara to the victims of the school shooting in Connecticut.

After the game, an emotional Nocerino said he wanted to "take the chance to dedicate my goal to the American families of the children killed in the school, my thoughts are only with them."

The Italian scored 35 seconds in. Nocerino, who has two young children, says he doesn't "know how much the dedication will help the dead American children, but everything I did today was only for them."

On the 113th anniversary of AC Milan's founding, the hosts (8-6-3) got own goals by Pescara in the 51st and 79th minutes and Stephan El Shaarawy scored the final goal in the 81st.

Defending champion Juventus defeated visiting Atalanta 3-0, with Mirko Vucinic scoring 80 seconds in and Andrea Pirlo and Claudio Marchisio adding goals. After Juventus built a three-goal lead, Thomas Manfredini was ejected in the 31st minute for his second yellow card.

Juventus (13-2-2) has a seven-point lead over second-place Inter Milan (11-5-1).

Sergio Pellissier scored in the 87th minute to give Chievo Verona a 1-0 win over visiting Roma and American midfielder Michael Bradley, who transferred from Chievo to Roma last summer.

Kerry Nomination Could Create Musical Chairs in the Senate

News that Amb. Susan Rice withdrew her name from consideration for Secretary of State may have brightened the days of both senators from Massachusetts.

Prior to Rice's withdrawal, she was considered one of the top two contenders for the job- the other is Sen. John Kerry, and with Rice out of the running, Kerry is "all but certain" to get the nomination, according to ABC's Jake Tapper. That means a vacant seat and a special election, which could benefit out-going Sen. Scott Brown, who lost his bid for reelection to Elizabeth Warren in November.

Brown is widely expected to seek out his old job and he would be viewed as a strong contender, particularly in a special election to fill Kerry's vacancy. Republicans have a tendency to perform better in special elections, which draw many fewer voters.

But it would be at least six months - assuming that Kerry is indeed nominated as Secretary of State and assuming that Brown wins a special election - before he could re-join the Senate.

Massachusetts law dictates that a special election cannot take place sooner than 145 days from the time an out-going Congress member's resignation is effective, meaning that at least 145 days must pass between the date that member actually leaves their job and the date that the special occurs. At this juncture in time, even if Kerry is nominated tomorrow and has an incredibly quick confirmation at the beginning of the next Congress, the earliest conceivable date to reach this mark is in June, 2013.

The special cannot occur more than 160 days from the time that the resignation is effective.

Brown's victory in a special election would not be a sure thing. Although he leaves office with high approval ratings- exit polls from the 2012 election showed him with a favor-ability rating of 60 percent- but Massachusetts is a solidly Democratic state, and there are many Democrats in elected office in the state who could challenge Brown.

In an odd twist of political gamesmanship, the law requiring a special election instead of an appointment from the Governor in the event of a vacant seat was passed by Democrats passed in Massachusetts in 2004 in case Kerry resigned if he won the presidency. He did not. But Democrats at the time were trying to take the appointment power away from the sitting Republican governor- Mitt Romney.

A request for comment from Sen. Brown's office on the news was not immediately returned.

?I am an artist living in Philadelphia, PA! My chosen mediums are photography and graphics arts. I was educated in both fields from several different outlets including classroom training and self teachings. After I learned all the technical aspects I could, I threw them away and began creating art only the way I visualized. Growing up in the Philadelphia school system, I felt uncultured as a student and completely unprepared for life, much less college. I was desperately looking for something to inspire and fill me with passion. I took several different courses in college including communications, education, computer science and business but nothing could hold my attention until I started taking art classes. My first two being Photography and Art History. It opened a new world to me and I became engulfed in photography and graphic design. My photos have been featured in several local papers and a few exhibits but the majority was personal work for myself and others.?

Cruz takes a pause to?sip his hot Starbucks coffee on?this raining Saturday?morning at Philadelphia International Airport .? He sits?next to?me dressed comfortably with his black hoodie over?his head as I only have a?breif time to chat with him?before my plane boards. Happy he?agreed to meet with me on such?short notice and time constraint he continues to speak articulately in a fluent manor about himself?

?My purpose? To be able to spread the gift of artistic expression to youth and individuals who are trying to find a greater purpose and beauty in their everyday lives. As children in school and even adults of all ages, society portrays an image of absolute success; a doctor, an entertainer, a lawyer, an athlete. Being an artist, a world changer, a self expressionist is just as important. When you share your gift of art with others, you change lives. I believe through art and self expression you find the person you want to be and discover how you want to change the world. I plan to spread my word by creating local art galleries and a foundation that supports art programs catered to my purpose. Most importantly, by continuing to create my art because that?s my way of changing the world.?

CRUZ: Thanks CeeJ!?The site is?finally?up and open for the business of sharing art and culture online. Everything is a bit bare so far but definitely check out my site. CJM: Do you consider yourself a trend setter?

CRUZ: No, I don?t! I think when someone is a true artist, being a trend setter should be the last thing on their minds. I think it jeopardizes complete artistry. I know that my work is a reflection of myself and my visions. When you are lucky enough to find your passion and you give yourself completely to it, it becomes greater than a trend but a movement. Movements lasts forever!?

CJM: When did you decide you wanted to be a photographer?

CRUZ: I decided to become a photographer after the first image I produced in the dark room back in 2000. When I saw that image, which is my photograph of the street on a rainy day, I was blown away. The fact that I could take this picture of a moment in time I thought was beautiful and make it ?come to life? again made me feel alive. I was searching in my life for something I could connect with. This felt right in my heart. I knew I had to give it my all.

CJM: Are there any black photographers who specifically has an influence on your work?

CJM: What inspires you to take pictures?

CRUZ: Darkness, sorrow and everyday life. To me, these three things go hand and hand. I see darkness and sorrow in my everyday life. It may sound negative to some people but it?s a thing of beauty and truly inspiring to me. I can see so clearly in darkness and sorrow; my visions, other people, reality, my subjects. My job after that is to interpret it so others can see it through my art.

CJM: How do you find your subjects to photograph?

CRUZ: My subjects always start in my head. I visual a theme, a person or object very abstractly most times. I take that foundation of my thought and when I get in front of it with my camera, that?s when my mind starts to race and that subject and idea in my head become clear and I capture what was there from the beginning but never saw completely.

CRUZ: Main main focus right now is www.vysualyze.com?now but I can never say specifically until it is actually happening because things always start out not so very clear to me until I am in front my found target with my?camera. One thing I do want to work on is a self connecting portrait series. I have this vision of the way people see themselves when they aren?t self aware. Its a developing idea that I want to really soak up a lot of my time doing because I feel like its going to be something that is defining for me artistically and personally.
